1. Overview
This Refund and Cancellation Policy outlines the terms related to fees paid to TherapyNeed and clarifies the policies regarding the services provided by independent Therapists listed on our platform, therapyneed.com (the “Platform”).
It is crucial to understand that TherapyNeed serves two distinct functions:
- A subscription service for Therapists to list their professional profiles (“Platform Fees”).
- A directory for Users to find and connect with these independent Therapists.
TherapyNeed does not process payments for therapy sessions, consultations, or any other professional services rendered by Therapists.
2. Platform Fees for Therapists
This section applies only to Therapists who purchase a subscription to be listed on the Platform.
2.1 Subscription Fees
Therapists may be required to pay a subscription fee to create and maintain a profile on the Platform (“Listing Fee”). All Listing Fees are billed in advance on a recurring basis (e.g., monthly or annually) as agreed upon at the time of purchase.
2.2 Cancellation of Therapist Subscription
A Therapist may cancel their subscription at any time by providing written notice to support@therapyneed.com or through their account dashboard.[1] The cancellation will take effect at the end of the current paid billing cycle. The Therapist’s profile will remain active until the end of that period.
2.3 Refund Policy for Listing Fees
Listing Fees paid to TherapyNeed are generally non-refundable.[2] We do not provide refunds or credits for any partial subscription periods or for any unused time remaining on a subscription.[3] Once a payment is made, the service is considered rendered for that billing period. An exception may be made if a Therapist cancels within a specific promotional “money-back guarantee” period, which would be explicitly stated at the time of purchase.[1]
3. Therapist Booking and Cancellation Policies for Users
This section applies to Users who book sessions with Therapists found through the Platform.
3.1 Independent Policies
Each Therapist on the Platform is an independent contractor who sets their own policies regarding:
- Session fees and payment methods.
- Booking and appointment scheduling.
- Cancellations, no-shows, and rescheduling.
- Refunds for their professional services.
3.2 User Responsibility
When you book a session with a Therapist, you are entering into a direct agreement with that Therapist. It is your responsibility to understand and agree to their individual cancellation and refund policies before making a payment or scheduling a session. TherapyNeed is not a party to this agreement and cannot enforce it.
TherapyNeed is not responsible for any payments, refunds, or disputes between a User and a Therapist. All such matters must be resolved directly between the User and the Therapist.
4. Dispute Resolution Process
It is important to distinguish between disputes involving TherapyNeed’s platform services and disputes between Users and Therapists.
4.1 Disputes Involving Platform Fees
If a Therapist has a dispute regarding a Listing Fee or their subscription with TherapyNeed, they should contact our support team directly at support@therapyneed.com. We will make a good faith effort to resolve the issue informally.[4]
4.2 Disputes Between Users and Therapists
TherapyNeed will not mediate or resolve disputes between Users and Therapists related to therapy sessions, payments for services, cancellations, or the quality of therapeutic care. Such disputes must be resolved directly between the parties involved. If a resolution cannot be reached, the parties may need to pursue other legal remedies as outlined in their direct agreement. The governing law for such disputes will be as agreed between the user and therapist, or as determined by the jurisdiction where the therapist practices.
4.3 EU Online Dispute Resolution
For consumers in the European Union, if a dispute with TherapyNeed regarding our direct services (such as a Therapist’s Listing Fee) cannot be resolved through our support channels, you may be able to use the EU’s Online Dispute Resolution (ODR) platform. This platform facilitates out-of-court settlements. You can access the ODR platform here: http://ec.europa.eu/odr.[5] Please note, this does not apply to disputes with independent Therapists.
