This Professional Liability Disclaimer clarifies the legal relationship between you (the “User”), the independent mental health professionals (“Therapists”) listed on our platform, and TherapyNeed (“we,” “us,” “our”), operated by Tourpraha s.r.o. It specifically addresses our role and limitations regarding the professional services offered by Therapists.
This document is an integral part of our Terms of Service and should be read in conjunction with our Medical Disclaimer. By using therapyneed.com (the “Platform”), you agree to the terms laid out in this disclaimer.
2. Platform’s Role and Non-Responsibility
TherapyNeed functions exclusively as a neutral technology platform and directory. Our role is strictly limited to:
- Providing a searchable directory of independent Therapists.
- Facilitating the initial contact between Users and Therapists.
TherapyNeed is not a party to the therapeutic relationship between a User and a Therapist. We do not provide, oversee, or intervene in the therapeutic process. Therefore, we expressly disclaim all responsibility and liability for any professional advice, diagnosis, treatment, or any other services provided by a Therapist to a User. We are not liable for any acts, omissions, negligence, or misconduct of any Therapist.
3. Independent Contractor Relationship
All Therapists listed on the Platform are independent contractors, not employees, agents, partners, or joint venturers of TherapyNeed. This means:
- No Supervision or Control: We do not supervise, direct, or control the manner in which Therapists provide their services. Therapists exercise their own independent professional judgment.
- Independent Business: Each Therapist operates their own independent practice and is solely responsible for their professional obligations, including but not limited to, maintaining valid licenses, adhering to professional ethics, and complying with all applicable laws and regulations.
- No Endorsement: The inclusion of a Therapist on our Platform does not constitute an endorsement, recommendation, guarantee, or warranty of that Therapist’s competence, quality of service, or professional qualifications.
4. User’s Responsibility for Therapist Selection
The choice to engage with a Therapist is yours and yours alone. By using our Platform, you acknowledge and agree that you are solely responsible for:
- Vetting and Selection: Conducting your own due diligence to select a Therapist who is suitable for your specific needs. This includes verifying their credentials, experience, licenses, and ensuring you are comfortable with their therapeutic approach.
- Evaluating Services: Assessing the quality, appropriateness, and effectiveness of the services you receive directly from the Therapist.
- Financial Arrangements: All financial transactions and agreements for therapy services are handled directly between you and your chosen Therapist. TherapyNeed is not involved in billing, payment, or insurance matters.
5. Assumption of Risk
You knowingly and voluntarily assume all risks associated with selecting and engaging in a professional relationship with a Therapist you find through our Platform. This includes, but is not limited to, the risk of professional malpractice, negligence, or unsatisfactory outcomes. You agree that your sole recourse for any issues arising from the therapy services will be directly with the Therapist and not with TherapyNeed.
